Royal Canadian Mounted Police Act

The Civilian Review and Complaints Commission for the Royal Canadian Mounted Police is established, consisting of a Chairperson and not more than four other members, one of whom may be a Vice-chairperson, appointed by the Governor in Council.

A person is not eligible to be a member of the Commission if that person

  • is a member or former member of the Royal Canadian Mounted Police; or
  • is not a Canadian citizen or a permanent resident within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act.

The Governor in Council shall, before appointing a person as a member of the Commission, consider the need for regional representation in the membership of the Commission.

A member of the Commission is eligible for reappointment on the expiry of that member’s term of office.

The Chairperson is a full-time member of the Commission. The others members may be appointed as full-time or part-time members of the Commission.

Each member of the Commission holds office during good behaviour for a term of not more than five years but may be removed for cause at any time by the Governor in Council.

Members of the Commission are to be paid the remuneration that is to be determined by the Governor in Council.

The Chairperson is the chief executive officer of the Commission and has supervision over and direction of the work and staff of the Commission.

In the event of the absence or incapacity of the Chairperson or if the office of Chairperson is vacant, the Vice-chairperson has all the powers, duties and functions of the Chairperson. In the event of the absence or incapacity of the Vice-chairperson or if the office of Vice-chairperson is vacant, the Minister may authorize another member of the Commission to exercise the powers and perform the duties and functions of the Chairperson, but a member of the Commission so authorized is not entitled to act as Chairperson for more than 90 days without the approval of the Governor in Council.
